Smata (“Smata,” “we,” “us,” or “our”) is operated by TheDairy, Inc. (“TheDairy”).

This Privacy Policy describes the manner in which Smata collects, uses, stores, discloses, and otherwise processes information obtained through the Smata mobile application, related websites, software, features, content, and associated services (collectively, the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agreed to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, you should discontinue use of the Service immediately.

1. Information We Collect

Information You Voluntarily Provide

When you create an account, interact with the Service, or otherwise communicate with us, we may collect certain information that you voluntarily provide, including but not limited to:

  • Full name
  • Email address
  • Google account information
  • Profile photograph or avatar
  • School, university, or campus affiliation
  • User-generated content, including study session posts, captions, descriptions, comments, and uploaded photos
  • Communications, feedback, support requests, or correspondence submitted to us

You acknowledge that any information you choose to submit through the Service may be visible to approved friends or connections within the platform, depending on your privacy settings and use of the Service.

Location Information

Smata collects and processes device GPS location information during active study sessions and related platform functionality.

Location information may be used to:

  • Track and display study sessions
  • Generate maps, statistics, and productivity insights
  • Enable friend-based social and accountability features
  • Improve platform functionality and user experience
  • Detect misuse, fraud, or unauthorized activity

Study sessions, associated locations, and related posts are visible only to approved friends within the Service.

You may disable location permissions through your device settings at any time; however, certain features of the Service may become unavailable or function improperly as a result.

Automatically Collected Information

When you access or use the Service, we may automatically collect certain technical and usage-related information, including:

  • Device type and identifiers
  • Operating system and application version
  • IP address
  • Mobile carrier and network information
  • Usage analytics and interaction data
  • Session activity and engagement metrics
  • Crash reports, diagnostics, and performance logs

This information may be collected through cookies, SDKs, analytics tools, log files, and similar technologies.

2. How We Use Information

  • Facilitate Google Sign-In authentication
  • Display study sessions, profiles, statistics, and social features

  • Enable friend discovery and social interactions

  • Detect, investigate, and prevent fraud, abuse, harassment, or unauthorized activity
  • Respond to support inquiries and communicate with users
  • Enforce our Terms of Service and Community Guidelines
  • Comply with applicable legal obligations and regulatory requirements

We may also aggregate or anonymize information for analytics, research, operational, or product development purposes.

3. Friend Visibility and Location Sharing

Smata is designed as a friend-based productivity and accountability platform.

  • Study sessions are visible only to approved friends
  • Posts are not publicly searchable or publicly indexed
  • User-uploaded photos are visible only to approved friends
  • Location information is not publicly accessible

Notwithstanding the foregoing, users should exercise caution when sharing location information or connecting with other users through the Service.

You acknowledge and agree that:

  • Sharing location information carries inherent privacy and safety risks
  • Smata cannot guarantee the conduct, intentions, or actions of other users
  • You are solely responsible for managing your privacy settings, friend relationships, and interactions within the Service

4. Google Sign-In and Authentication

Smata utilizes Google authentication and identity services for account access and login functionality.

When you authenticate through Google, we may receive certain account information authorized by you, including:

  • Name
  • Email address
  • Profile picture
  • Basic profile and account information

We do not receive, collect, or store your Google account password.

Your use of Google authentication services is additionally subject to Google’s applicable terms, policies, and privacy practices.

5. Third-Party Services and Providers

We may utilize third-party vendors, service providers, infrastructure providers, analytics providers, and business partners in connection with operation of the Service, including but not limited to:

  • Google Sign-In
  • Google Maps Platform
  • Analytics and crash reporting providers
  • Cloud hosting and infrastructure providers

These third parties may access, process, store, or transmit information as necessary to perform services on our behalf.

We are not responsible for the privacy practices, policies, or content of third-party services, and users are encouraged to review the applicable privacy policies of such providers independently.

6. Data Retention

We retain personal information and related data for as long as reasonably necessary to:

  • Provide and maintain the Service
  • Fulfill the purposes described in this Privacy Policy
  • Maintain security, integrity, and operational functionality
  • Comply with legal, regulatory, tax, accounting, or reporting obligations

We reserve the right to delete, anonymize, aggregate, or otherwise remove information when it is no longer reasonably necessary for these purposes.

Residual copies of information may remain in backups, caches, archives, or system logs for a limited period of time.

7. Account and Data Deletion

Users may request deletion of:

  • Their account
  • User-generated content
  • Associated personal information maintained by Smata

This can be done using the in-app feedback option or by emailing our email in the contact section below. Upon receipt of a verified deletion request, we will take commercially reasonable steps to delete or anonymize applicable information within a reasonable timeframe.

Notwithstanding the foregoing, certain information may be retained where necessary to:

  • Comply with legal obligations
  • Detect or prevent fraud, abuse, or security incidents
  • Resolve disputes
  • Enforce agreements
  • Maintain legitimate business and operational records
  • Preserve backup or archival systems for a limited duration

8. Security

We implement commercially reasonable administrative, technical, organizational, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, misuse, or destruction.

However, no method of electronic transmission, storage, or processing is entirely secure, and we cannot guarantee absolute security of information transmitted to or through the Service.

Accordingly, users acknowledge and accept that use of the Service and transmission of information occurs at their own risk.

9. Children’s Privacy

The Service is not directed toward, intended for, or designed to attract individuals under the age of 13.

We do not knowingly collect personal information from children under 13 years of age. If we become aware that personal information has been collected from a child under 13 without appropriate authorization, we will take reasonable steps to delete such information promptly.
